Abstract

This study aims to analyze the criminal liability of corporations as perpetrators of forest destruction by examining Decision Number 35/Pid.B/LH/2022/PN Tjk. The issue of forest destruction involving corporations is a complex legal issue, given the characteristics of the perpetrators as legal entities and their often systematic and organized modus operandi. The approaches used were normative juridical and empirical juridical, with data collection techniques through document studies and interviews. The results of the study indicate that the panel of judges has determined corporations as legal subjects criminally responsible, but there are still obstacles in proving the elements of corporate culpability and gaps between legal norms and their implementation in the field. Therefore, strengthening legal instruments and more effective enforcement strategies are urgently needed to achieve legal certainty and ecological justice.
