Restorative Justice Prosecutor’s Office Criminal LawAbstract
This research seeks to examine the determinants that shape the application of restorative justice in handling criminal cases at the Bandar Lampung District Prosecutor’s Office. The study originates from the transformation of Indonesia’s criminal justice paradigm from a retributive orientation emphasizing punishment, toward a restorative approach that prioritizes reconciliation between offenders and victims. The research adopts a normative juridical method with statutory, conceptual, and case-based approaches. Data were obtained through an extensive literature review involving relevant laws, legal theories, and prior academic findings. The results reveal that the effectiveness of restorative justice implementation is primarily driven by three dimensions: legal aspects ensuring certainty and fairness, institutional aspects concerning prosecutorial roles and supporting facilities such as the Restorative Justice House, and socio-cultural aspects encompassing public participation and awareness of law. The interconnection of these dimensions collectively determines the overall success of restorative justice at the prosecutorial level. This study concludes that the restorative justice practice in Bandar Lampung has been effectively implemented and represents a more humanistic and socially constructive form of criminal law enforcement in Indonesia.Downloads
